In addition to the Kagan confirmation hearings this morning, did anyone notice the opinions the Supreme Court of the United States of America released today? Two major ones that have been watched very closely in conservative and liberal circles alike were decided on 5-4 decisions.
Christian Legal Soc. Chapter of Univ. of Cal., Hasting College of Law v. Martinez: The court ruled that Christian religious groups cannot take student activity fee money and use it to discriminate against gays and lesbians by saying homosexuality is a sin and therefore forbidding them from serving as leaders of the organization.
The underlying theory is that the school had an “all-comers” policy that required all recognized student organizations (RSO) to be open to all students and that if you want to take Caesar’s money (the benefit of becoming an RSO), then you live by Caesar’s rules given that they were not discriminating against any specific religion and were applied equally across the board to everyone (e.g., a gay group couldn’t ban Christians, either). Part of Sarbanes-Oxley Struck Down as Unconstitutional: Although the impact will be limited, part of the fraud law passed after the Worldcom and Enron scandals ten years ago were struck down based upon separation of power concerns. It involves a national auditing board.
